Terms of service
Introduction
The trading platform is managed by Lody Wojtas Sp. z o.o., headquartered in Rzeszów, ul. 3 Maja 14/2, 35-030 Rzeszów, VAT No.: 8133836227, REGON: 385705676, registered in the National Court Register (KRS) under number 0000832207, District Court in Rzeszów, 10th Commercial Division.

These regulations (compliant with the Act on the Provision of Electronic Services of 18 July 2002) define the rules for using the Trading Platform, concluding sales agreements, and the rights and obligations of the Customer and the Seller.
§1. Definitions
- Trading Platform – a website enabling orders to be placed for the Seller's goods.
- Seller – Lody Wojtas Sp. z o.o., headquartered in Rzeszów.
- Customer – a natural person, legal entity, or organisational unit that enters into an agreement with the Seller.
- Service – services provided electronically by the Seller.
- Sales Agreement – an agreement concluded with the Customer via the Trading Platform.
- Goods – a product that the Customer purchases via the Trading Platform.
- Customer Panel – a place in the Seller's system where the Customer's data is stored.
- Order Form – a form enabling a purchase to be made.
- Newsletter – a service allowing subscription to the Seller's offers and promotions.
- Business Day – Monday through Friday, excluding public holidays.
§2. General Provisions
- The Seller undertakes to provide services in accordance with the Regulations.
- The Customer undertakes to comply with applicable laws and social norms when using the Platform.
- The Customer must comply with the rules set out in the Regulations.
- The Seller complies with personal data protection rules in accordance with GDPR.
- The Customer consents to the processing of their personal data for the purpose of fulfilling the order.
- Providing unlawful or offensive content is prohibited.
- Use of the Platform carries the risk of access by unauthorised persons.
§3. Services and Conditions of Provision
- The Seller provides services such as:
- enabling the placement of orders,
- access to the Customer Panel,
- sending newsletters.
- Services are free of charge.
- The service agreement lasts until the order form is completed or submitted to the Seller.
- Services are available around the clock.
- The Customer must be registered in order to place an order.
- The Newsletter service is provided for an indefinite period.
- The Customer must meet technical requirements (internet access, a browser supporting cookies).
- Internet access costs are borne by the Customer.
§4. Registration on the Platform
- To gain access to the Platform, the Customer may enter into a separate agreement.
- Upon registration, the Customer receives login credentials.
- The Customer must not share their access credentials with unauthorised persons.
- The Customer bears responsibility for the consequences of disclosing their credentials.
§5. Sales Agreement
- Sales agreements are concluded on the basis of the General Terms and Conditions of Sale (GTC).
- In the case of individual arrangements with the Customer, these take precedence.
- The Customer should familiarise themselves with the GTC.
- Goods offered by the Seller are new and free from defects.
- Product information constitutes an invitation to enter into an agreement.
- Prices available after logging in are confidential.
- The Seller reserves the right to change prices and introduce promotions.
- Orders may be placed 24 hours a day, 7 days a week.
§6. Seller's Liability
- The Seller is not liable for incorrect data entered by the Customer.
- The Seller is not liable for use of the Platform that is inconsistent with the Regulations.
- The Seller may suspend access to Platform services for maintenance purposes.
§7. Withdrawal from Agreement and Complaints
- The Customer may terminate the agreement without giving a reason.
- The Seller may terminate the agreement due to the Customer's breach of the Regulations.
- The Customer may submit complaints electronically.
- Complaints should include the Customer's details and information regarding the complaint.
- Complaints are processed within 14 days.
- The Seller may cancel an order from a Customer who is not a consumer.
§8. Intellectual Property
- Content on the Platform is protected by copyright and is the property of the Seller.
- The Customer may use the content solely for personal use.
- The Customer does not acquire any copyright to the Platform's content.
- Copying, modifying, or distributing Platform content without the Seller's consent is prohibited.
§9. Final Provisions
- The Seller may amend the Regulations, notifying Customers 14 days before the changes take effect.
- Matters not regulated herein are governed by Polish law.
- Disputes will be resolved by the court with jurisdiction over the Seller's registered seat.
- The Regulations enter into force on 8 January 2025.
