These regulations (in accordance with the Act on the provision of services by electronic means of 18 July 2002) define the rules for using the Trading Platform, concluding sales agreements, and the rights and obligations of the Customer and the Seller.
§1. Definitions
- Trading platform – a website enabling placing orders for the Seller’s Goods.
- Seller – Lody Wojtas Sp. z o. o. with its registered office in Rzeszów.
- Customer – a natural person, legal person or organizational unit that concludes an agreement with the Seller.
- Service – services provided electronically by the Seller.
- Sales Agreement – an agreement concluded with the Customer via the Trading Platform.
- Goods – a product that the Customer purchases via the Trading Platform.
- Customer Panel – a place in the Seller’s system where Customer data is stored.
- Order form – a form enabling you to make a purchase.
- Newsletter – a service enabling subscription to the Seller’s offers and promotions.
- Working day – a day from Monday to Friday, excluding public holidays.
§2. General provisions
- The Seller undertakes to provide services in accordance with the Regulations.
- The Client undertakes to comply with legal provisions and principles of social coexistence when using the Platform.
- The Customer must comply with the rules set out in the Regulations.
- The Seller complies with the principles of personal data protection in accordance with the GDPR.
- The customer consents to the processing of his or her personal data for the purpose of fulfilling the order.
- You are prohibited from providing illegal or offensive content.
- Using the Platform involves the risk of access by unauthorized persons.
§3. Services and terms of their provision
- The seller provides services such as:
- enabling the placing of orders,
- access to the Customer Panel,
- sending newsletters.
- The services are free of charge.
- The service provision agreement lasts until the order form is completed or sent to the Seller.
- Services are available 24 hours a day.
- The customer must be registered to place an order.
- The Newsletter service is provided for an indefinite period.
- The customer must meet the technical requirements (internet, browser supporting Cookies).
- The costs of Internet access are borne by the Client.
§4. Registration on the Platform
- In order to obtain access to the Platform, the Client may enter into a separate agreement.
- After registration, the Customer receives login details.
- The customer may not disclose access data to unauthorized persons.
- The customer is responsible for the consequences of disclosing data.
§5. Sales Agreement
- Sales agreements are concluded on the basis of the General Terms and Conditions of Sale (GTCS).
- In the case of individual arrangements with the Client, these take precedence.
- The customer should familiarize themselves with the General Terms and Conditions.
- The Goods offered by the Seller are new and free from defects.
- Information about the Product constitutes an invitation to conclude a contract.
- Prices available after logging in are confidential.
- The Seller has the right to change prices and introduce promotions.
- Orders can be placed 24 hours a day, 7 days a week.
§6. Seller's Liability
- The Seller is not responsible for incorrect data entered by the Customer.
- The Seller is not responsible for use of the Platform that is inconsistent with the Regulations.
- The Seller may suspend access to the Platform services for maintenance purposes.
§7. Withdrawal from the contract and complaints
- The customer may terminate the contract without giving reasons.
- The Seller may terminate the contract due to violation of the Regulations by the Customer.
- The customer may submit complaints electronically.
- Complaints should include the Customer's data and details regarding the complaint.
- Complaints are processed within 14 days.
- The Seller may cancel the order of a Customer who is not a consumer.
§8. Intellectual Property
- The content on the Platform is protected by copyright and is the property of the Seller.
- The customer may use the content only for personal use.
- The Client does not acquire any copyrights to the content of the Platform.
- It is prohibited to copy, modify or distribute the content of the Platform without the consent of the Seller.
§9. Final provisions
- The Seller may change the Regulations, informing Customers 14 days before the changes are introduced.
- In matters not regulated, the provisions of Polish law shall apply.
- Disputes will be resolved by the court having jurisdiction for the Seller's registered office.
- The Regulations enter into force on 8 January 2025.
